Good morning, a client of mine has got in touch to help them find an individual for their full time Senior Enforcement Officer Position. I have attached the details of the role below.

The purpose of this role is to:

  • Provide technical expertise, advice and direction to internal and external customers when solving  problems or managing risks
  • Apply a high level of expert knowledge within a technical area of expertise and manage sensitive, open ended and complex case or project based work
  • To deal with enquiries and complaints relating to all forms of development and breaches of planning control.
  • To identify and investigate all breaches of planning control.
  • To give advice to members of the public and others, including, those responsible for a breach, and try to find ways to resolve the breach.
  • To ensure that, where a breach is found, appropriate action is taken, where expedient to do so.
  • To take formal enforcement action through to prosecution, where necessary, to protect the environment of the Forest of Dean in the public interest and the reputation of the Local Planning Authority.

Key Description

  1. Use detailed, technical knowledge within the subject matter to objectively analyse situations and make decisions that meet the needs of all stakeholders with limited guidance and direction
  2. Working in a multi-disciplinary team on technical cases and projects to a highly efficient and effective standard
  3. Be responsible for small projects or input into large projects
  4. Maintain a detailed understanding of appropriate legislation, policy, procedure and guidelines and make informed assessments, advise stakeholders and take action
  5. Ability to interpret and find solutions to ambiguous and partial information
  6. Play an integral role in innovating products and continuously improving services
  7. Act as a lead technical advisor within the relevant service area
  8. Mentor and train colleagues
  9. Carry out duties with discretion, integrity and maintain confidentiality
  10. Deliver commitments and take ownership of own caseload, reshaping of plans to deliver required outcomes
  11. Ensure that issues and problems are effectively mitigated and solutions developed which meet customer needs
  12. Monitor and oversee the maintenance of accurate, precise and up-to-date records of enforcement investigations, monitor heavy goods vehicle licensing, undertaking other relevant and appropriate development management work and liaising with colleagues in other departments of the Council, other Councils and outside agencies.
  13. Understand and demonstrate commitment in delivering the key performance indicators within the function
  14. Receive and record enquiries and complaints from members of the public and others in connection with actual and perceived breaches of planning control and give advice relating to their expectations as to when the matter may be resolved and the action that the Local Planning Authority can take.
  15. Undertake investigations into alleged breaches of planning control in accordance with the Regulation of Investigatory Powers Act.,
  16. Prepare reports relating to breaches of planning control for the information and decision of the Planning Committee, (Development Manager where cases are urgent), including a recommendation on what action should be taken, including a full history of the site, the action that had been taken to date, details of the relevant Development Plan Policies, and reference to Human Rights legislation.
  17. Advise persons on enforcement issues and the requirements of the relevant legislation. Interview of persons, if necessary under caution, in compliance with the Police and Criminal Evidence Act.
  18. Preparation of Planning Contravention Notices, Breach of Condition Notices and draft Enforcement Notices together with any necessary supporting plans and other documentation.  Prepare statements of evidence and appear in appeal inquiries and court cases as an expert witness.

Essential Requirements, Qualifications, Skills and Abilities:

  • A qualification in planning or a related discipline, equivalent to a degree or relevant experience of five years
  • knowledge of Town and Country Planning legislation
  • A minimum of at least three years’ experience within a Local Government or related environment
  • GCSE Maths and English or equivalent to grade C/4 or higher
  • Experience of working flexibly as part of a team and collaborating with colleagues and stakeholders
  • Experience of being involved in continuously improving services and developing products to meet customer need
  • Ability to remain calm and confident when dealing with challenging customers and environments
  • Ability to resolve complex issues by negotiation
  • Deliver commitments and take ownership of own caseload, reshaping of plans to deliver required outcomes
  • Demonstrate commitment and resilience to succeed
  • Ability to work independently under pressure and within tight deadlines
  • Excellent written and verbal communication skills
  • Competent in using a range of technology and software packages, including Microsoft and Google
