Planning Enforcement Consultant

I am currently working with a Bedfordshire based Local Planning Authority who are looking to bring on an Enforcement Officer for an initial 3-month period, with a view to extend the contract should all go well.

Your job purpose would be to provide a high-level service for the investigation of alleged breaches of planning control within the Gypsy and Traveller community and to advise on appropriate action, and to take action, to resolve breaches of planning control in accordance with Government Guidelines and the LPAs Planning Enforcement Policy. Your general accountabilities in the role are as follows:

  • To investigate complaints alleging breaches of planning control within time restraints as set out in the LPAs Planning Enforcement Policy. To include the following:
  • Trace the planning history of the site.
  • Carry out site visits, take dimensions, check buildings to plans, and assess if there is a breach of planning control and action that should be taken.
  • Advise contravener of breach and action that should be taken to resolve.
  • Advise complainants and Ward members.
  • Update action notes on Acolaid database, and regularly review cases for action.
  • Liaise with other Council Officers for example Conservation, Highways and Public Protection. Liaise with other parties for example IDB.
  • To take formal enforcement action when appropriate, to include the following:
  • Liaise with Team Leader and Legal section to decide action to take.
  • Prepare action reports and formal Notices for example Enforcement Notice, Temporary Stop Notice, Breach of Condition Notice.
  • Serve formal Notices on all interested parties and prepare Statements of service. Also serve Injunctions obtained from High Court.
  • Check compliance with requirements of Notices.
  • Undertake interviews under caution.
  • Prepare witness statements for Council Solicitor for Court action.
  • Give evidence at Court and at Appeal Hearings.

 

  • To answer general planning enforcement queries, and specifically queries relating to own cases.
  • To update Acolaid with all actions and correspondence, and close cases when breach resolved or no further action to take.
  • To ensure compliance with appropriate legislation, Council Policies, the Constitution, Financial regulations and other requirements of the Council.
  • To work as a key member of the team helping to foster positive teamwork and participating in the creation and maintenance of an environment where ideas and innovations will be explored, and work practices challenged.
  • To be available to carry out any other appropriate duties as may be required by management and to the grading level of the post and competence of the post holder.
